BACKGROUND
This Terms of Use Agreement ("CONTRACT") is a legally binding agreement between you ("STUDENT") and Drive Safe Driving School ("COMPANY"). By enrolling in the Defensive Driving / Driving Safety course, STUDENT agrees to be bound by all terms herein and applicable Texas law.

PURPOSE AND ELIGIBILITY
The Texas Driving Safety Course (Defensive Driving) is approved by TDLR and may be used for:
- 1.Dismissal of one eligible moving traffic violation every 12 months, upon court approval; and
- 2.A mandatory 10% automobile insurance premium discount under Texas Insurance Code §2053.051.
To be eligible for ticket dismissal, STUDENT must obtain court approval before enrolling. Drive Safe Driving School does not guarantee ticket dismissal or insurance discounts; those are solely at the discretion of the court and insurance provider, respectively.
STUDENT must have a valid Texas driver license or learner license. The course is not available to holders of a commercial driver license (CDL) for CDL-related violations.
SECURITY AND VALIDATION POLICY
This course includes identity-verification and validation mechanisms as required by TDLR. STUDENT acknowledges that:
- 1.It is a criminal offense to circumvent or allow another person to complete this course on STUDENT's behalf;
- 2.Circumvention may result in loss of the Certificate of Completion, court sanctions, higher insurance premiums, and forfeiture of all fees; and
- 3.STUDENT shall be the sole individual completing all coursework.
Misrepresenting identity to obtain a state-approved certificate is a criminal offense under the Texas Penal Code.
TUITION AND FEES
The total cost of the course is stated at the time of enrollment. A court-filing fee may be charged separately by the court and is not included in the course price.
COURSE ACCESS AND SCHEDULE
The course is available online 24 hours per day, 7 days per week. STUDENT must complete the course within the court-ordered deadline, or within 90 days of enrollment if no court deadline applies. STUDENT is responsible for monitoring their own court deadline.
Drive Safe Driving School is not responsible for any court deadlines missed due to STUDENT's failure to complete the course on time. STUDENT should enroll well in advance of any court-ordered completion date.
COURSE COMPLETION AND CERTIFICATE
To receive a Certificate of Completion (DSC-10), STUDENT must:
- 1.Complete all 6 hours of required instruction across all lessons;
- 2.Pass all lesson quizzes with a minimum score of 70%;
- 3.Pass the final examination with a minimum score of 70%; and
- 4.Satisfy all TDLR-required identity and validation checks.
STUDENT must submit the Certificate of Completion to the court within 90 days of the citation date or as ordered by the court. Drive Safe Driving School will issue the certificate within 2 business days of course completion. If STUDENT does not receive the certificate within 5 business days, STUDENT must contact Drive Safe Driving School immediately.
A STUDENT who fails the final examination has failed the course and is not entitled to a refund. STUDENT may re-enroll at the current course price.
CANCELLATION AND REFUND POLICY
STUDENT may request a full refund within 7 days (168 hours) of enrollment, provided the course has not been completed or failed. After 7 days, or after course completion or failure, no refunds will be issued.
To cancel, contact Drive Safe Driving School at support@drivesafedrivingschool.com. Refunds are processed within 15 business days of confirmation.
COURT COORDINATION
STUDENT is solely responsible for:
- 1.Obtaining court permission to take the defensive driving course prior to enrollment;
- 2.Submitting the Certificate of Completion to the court by the required deadline; and
- 3.Paying any court fees, administrative fees, or other charges imposed by the court. Drive Safe Driving School has no responsibility or authority regarding court proceedings, deadlines, or outcomes.
INSURANCE DISCOUNT
Under Texas Insurance Code §2053.051, a STUDENT who completes a TDLR-approved driving safety course is entitled to a mandatory 10% discount on the liability and collision portions of their automobile insurance premium for two years following course completion. STUDENT should present the Certificate of Completion to their insurance provider to obtain this discount. Drive Safe Driving School cannot guarantee that the discount will be applied and is not responsible for any insurer's failure to honor this requirement.
GOVERNING LAW
This CONTRACT is governed by Texas law. Any dispute not subject to arbitration shall be resolved in the appropriate state or federal court in Texas.
